These Website Terms of Use apply to the website operated by Metal Earth Investments Pty Ltd trading as Property Recruitment Partners (PRP, we, us or our), including job listings, candidate profile features, employer registration and other website content.
By accessing or using the website, you agree to these terms. If you register for an employer account, you will also be asked to confirm your agreement before the account is submitted for approval. If you do not agree, do not use the website or register an account.
1 About PRP and these terms
PRP provides specialist recruitment and related services. These terms govern use of the website. They do not appoint PRP to conduct a recruitment assignment and do not replace any written terms of business, recruitment agreement, confidentiality undertaking or other agreement between PRP and a client.
If these website terms conflict with a separate written agreement for recruitment services, the separate agreement prevails to the extent of the conflict.
2 Website information
Website content is general information. Job descriptions, remuneration, availability, candidate information, market commentary and other content may change or become unavailable. We may correct, update or withdraw content when reasonably necessary.
A job listing is not an offer of employment. Candidate information is not a warranty of suitability. Salary guides, career articles and market information are general only and are not legal, financial, tax or employment advice. You should make your own enquiries and obtain professional advice where appropriate.
3 Candidates and job applications
When you submit a CV, application, enquiry or other information, you confirm that it is accurate to the best of your knowledge, is not misleading in any material respect, and may lawfully be provided to us.
Submitting information allows PRP to assess and manage your enquiry in accordance with our Privacy Policy. It does not guarantee an interview, introduction, placement or employment. PRP and each employer retain discretion about whether to progress a recruitment process.
Submitting a CV does not give PRP unrestricted authority to identify you to employers. We will obtain separate authority before sending your identity or full candidate information to a prospective employer for a particular opportunity.
Online job applications may be processed through JobAdder or another service provider. Additional terms or privacy notices shown by that provider may apply to information you submit through its service.
4 Candidate profiles
PRP may display limited or anonymised candidate information where the candidate has given permission. A public profile or approved-employer profile is a preliminary recruitment summary. It may be incomplete, may change, and is not a reference, representation or guarantee about the candidate.
Candidate identities, CVs and detailed information remain subject to PRP's recruitment process and the candidate's authority. Employers must complete appropriate interviews, references, work-right checks, qualification checks and other due diligence before making an employment decision.
5 Employer registration and accounts
To register for or use an employer account, you must:
- be at least 18 years old and authorised to act for the organisation you identify
- provide accurate, current work and contact details
- use the account only for genuine recruitment or hiring purposes connected with your organisation
- keep your password and account access confidential and not share the account with another person
- notify PRP promptly if you suspect unauthorised access, loss of credentials or misuse
Registration does not create an automatic right of access. PRP may verify registration details and approve, decline, limit or suspend access where reasonably necessary to protect candidates, the website, PRP or another person. An account holder may ask us to close the account at any time.
6 Employer use of candidate information
Candidate information available to an approved employer is confidential and supplied only for genuine consideration of recruitment through PRP. Unless PRP agrees in writing, you must not:
- share candidate information outside authorised employees or advisers who need it for the same recruitment purpose and are bound to keep it confidential
- publish, sell, licence, copy in bulk, build a database from, scrape or use candidate information for marketing or unrelated purposes
- attempt to bypass PRP by identifying, approaching or contacting a candidate from profile information
- use candidate information in a way that is discriminatory, unlawful, misleading or inconsistent with the candidate's privacy
- retain candidate information longer than reasonably required for the permitted recruitment purpose or any lawful record-keeping obligation
You must tell PRP promptly if candidate information is lost, disclosed to an unauthorised person or accessed in a way that may compromise privacy or security.
7 Client enquiries and recruitment services
Submitting a vacancy, position brief or hiring enquiry through the website is an invitation to discuss services. It does not appoint PRP or require PRP to begin work. Fees, candidate ownership, replacement arrangements, exclusivity, payment and other recruitment terms are governed by the terms of business or agreement accepted for the assignment.
8 Acceptable use
You must use the website lawfully and must not:
- misrepresent your identity, authority, organisation, experience or intention
- gain or attempt to gain unauthorised access to an account, candidate information, system or data
- circumvent access controls, security measures, employer approval or content restrictions
- scrape, harvest, data mine or systematically extract website or candidate content, including by automated means
- introduce malicious code, interfere with the website, overload it or test its security without written permission
- use website content to send unsolicited marketing, compete unlawfully, infringe rights or harm another person
Reasonable indexing by ordinary public search engines is permitted where we have not used technical measures to prevent it.
9 Content you provide
You retain ownership of content you provide to PRP. You give us a non-exclusive permission to host, copy, use, adapt and disclose that content only as reasonably needed to operate the website, respond to your request and provide recruitment or related services in accordance with our Privacy Policy and any separate agreement.
You confirm that you have the right to provide the content and that our authorised use of it will not infringe another person's rights. We will obtain separate candidate permission before using personal information in a public or approved-employer candidate profile.
10 PRP intellectual property
The website, PRP name and logos, design, written content, candidate summaries, databases, selection and arrangement of material, and other intellectual property are owned by or licensed to PRP.
You may view and make a reasonable copy of public content for your own personal or internal business use. You must not reproduce, republish, modify, distribute, commercialise or create a competing database from our content without written permission, except where the law allows it.
11 Third party services and links
The website may link to or use third-party services, including JobAdder, job boards, professional networks, maps, video, analytics or social media. Those services are controlled by their providers and may have separate terms and privacy notices.
A link does not mean that PRP endorses every statement, product or service on the linked site. We are not responsible for a third party's content, availability, security or handling of information, except to the extent the law makes us responsible.
12 Privacy cookies and communications
Our Privacy Policy explains how we handle personal information. The website's cookie settings explain and allow choices about non-essential cookies where applicable.
We may send messages needed to operate an account, respond to an enquiry or manage a recruitment process. Marketing communications will be sent only where we have consent or are otherwise permitted by law and will include an appropriate way to opt out.
13 Website availability and security
We take reasonable care in operating the website, but we do not promise that it will always be available, uninterrupted, secure or free from errors. Maintenance, updates, provider outages, security events or other circumstances may affect access. You are responsible for using suitable device security and keeping your own copies of information you need.
14 Consumer rights and liability
Nothing in these terms excludes, restricts or modifies a right, remedy, guarantee or liability that cannot lawfully be excluded, including under the Australian Consumer Law.
To the maximum extent permitted by law, PRP is not liable for indirect or consequential loss arising solely from use of, inability to use, or reliance on general website content, or from a third-party website or service outside our reasonable control. This does not limit liability for our fraud, wilful misconduct or negligence where liability cannot lawfully be limited.
Where the law permits liability for a service to be limited, our liability may be limited, at our option, to supplying the service again or paying the reasonable cost of having it supplied again. Separate recruitment agreements may contain terms that apply specifically to those services.
15 Suspension and ending access
You may stop using the website or ask us to close your employer account at any time. We may suspend or end access where we reasonably believe these terms have been breached, an account is being misused, information is at risk, or suspension is needed to protect a candidate, another person or the website. Where appropriate, we will give notice and an opportunity to address the issue.
Terms concerning confidentiality, candidate information, intellectual property, liability and governing law continue to apply after access ends to the extent needed to give them effect.
16 Changes to these terms
We may update these terms when the website, services or law changes. Updated terms apply from the date shown on the website. If a change materially affects registered employer users, we will take reasonable steps to give notice. You may stop using the website and close your account if you do not accept an updated term.
17 General terms
If a provision is unlawful or unenforceable, it will be read down to the extent possible or severed without affecting the remaining provisions. A delay in exercising a right is not a waiver of that right.
These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts of New South Wales and courts entitled to hear appeals from them.
